According to an attention-grabbing story in the current ABA Journal eReport by Siobhan Morrissey, Florida's new Constitutional Amendment 8, the "three strikes, you're out" medical malpractice amendment, may have the unintended consequence of increasing the number of medical malpractice lawsuits filed, resulting in more settlements.
